MUI Rule Definitions Interpretation
MUI means the alleged, suspected or actual occurrence of an incident that adversely affects the health and safety of an individual, including acts committed or allegedly committed by one individual against another individual. Major unusual incidents include, but are not limited to, the following:

Abuse ~ Could the act be expected to result in harm or serious physical harm ~Staff roughly push the individual against locker, causing the individual to hit head on locker
Physical force that can reasonably be expected to result in harm or serious physical harm ~Law enforcement contact is required when the force results in physical harm or as otherwise defined in ORC 2903.0 ~Staff throws a punch at the individual; the individual ducks the punch
Sexual Abuse ~Includes inappropriate, unwanted or forcible touching. ~The individual alleged that an uncle kept touching the individual's "privates"
Unlawful sexual conduct or sexual contact as defined in 2907.01 of the ORC. ~Was the conduct/contact for the purpose of arousing either person? ~The individual alleges being raped by a peer..
Verbal Abuse ~What was the effect of the words or gestures on the individual? ~The individual alleges that the care provider threatened to punch them if the individual did not do the dishes.
 
Using words or gestures to threaten, coerce, intimidate, harass or humiliate an individual ~Staff threatens to give the individual's dog away if the individual tells on them for slapping another individual.
Misappropriation ~Was the individual separated from his/her assets or property as a result of the actions of the alleged PPI? ~Staff uses the individual's funds to purchase clothes, but staff gives the clothes to their own family members.
 
Depriving - Defrauding - Obtaining real or personal property of an individual by means prohibited by ORC. ~Staff used the individual's ATM card to make unauthorized cash withdrawals.
Neglect ~Was the alleged PPI supposed to be providing supervision/services and failed to do so? ~Staff are sleeping instead of providing the required 24-hour supervision.
When there is a duty to do so, failing to provide an individual with any treatment, care, goods, supervision or services necessary to maintain health and safety. ~Does not have to result in harm to individual. ~Staff doesn't change a dressing or apply antibiotic for 6 days.
  ~Law Enforcement contact is required when the failure results in harm.  
Death   ~The individual dies of heart failure at age 85.
Any cause ~The individual is found dead with multiple stab wounds.
Law Enforcement ~Was the individual arrested, charged or incarcerated? ~The individual robs a bank and is incarcerated.
 
Results in arrest, or filing of charges, or incarceration. ~The individual violates the terms of the probation and is jailed for 10 days.
Attempted Suicide ~Did the individual make an actual physical attempt to end life? ~After the individual stated she was going to kill herself, she stabs herself with scissors.
Actual physical attempt - regardless of whether harm resulted. ~No harm is required. ~The individual tries to hang self.
Relocation/Inability to Provide Services ~Did it result in overnight relocation? ~The individual is placed in a respite care facility following a flash flood at primary residence.
Fire, natural disaster or mechanical failure at any place at which the individual receives services that results in overnight relocation or inability to provide services for at least 24 hours. ~The furnace at residence breaks down in cold winter weather necessitating relocation to a hotel for 2 days.
Missing Person ~Is the absence longer than 8 hours or longer than is specified as allowable in the IP? ~The ISP allows for 4 hours unsupervised time. John goes out at 1:00 p.m. John has not returned by 6:00 p.m.
The individual cannot be located for a period of time longer than 8 hours unless the IP states differently, prior arrangements were made or the individual is in immediate jeopardy that necessitates law enforcement notification. ~If law enforcement is contacted to assist in a search, it is an MUI. ~ISP indicates 24 hours, 7 days a week supervision. The individual cannot be located in an immediate search of the home.
Medical Emergency ~Were emergency medical interventions given, such as Heimlich, CPR, surgery, resuscitation, IV's? (Note: this does not include first aid) ~The individual chokes on a hot dog and receives the Heimlich maneuver to clear airway.
Sudden onset of a medical condition that requires emergency medical intervention. ~Was the emergency medical intervention necessary to prevent the likelihood of death or serious harm? ~The individual complains of severe pain on side, vomiting and difficulty breathing. Transported by EMS to ER. Treated with IV's due to dehydration.
Unplanned/Unscheduled Hospital Admission ~Is the hospital admission unscheduled or unplanned admission? ~The individual has a history of high blood pressure, but was hospitalized unexpectedly due to pneumonia.
Any unplanned or unscheduled hospital admission (not expected as a part of a person's medical condition. Not included in ISP under specific criteria as to when person would be admitted) ~The individual reports severe pain. The individual is admitted for surgery to remove kidney stones.
Injury ~Did the injury require treatment that only a physician, physician assistant or nurse practitioner can provide? ~The individual falls down the basement stairs and breaks arm.
Any injury of an unknown or suspicious origin that requires treatment by a physician, physician assistant or nurse practitioner or any injury of a known or non-suspicious origin that has a significant impact on their physical health. ~Results in injuries requiring a total of 5 or more sutures or the equivalent. ~The individual sustains a laceration to head that requires 5 sutures for closure. Laceration resulted from a fall that was observed by staff.
  ~Broken bones, regardless of treatment, dislocation, or unexpected loss of teeth, serious burns, altered level of consciousness from an injury or any other serious injury.  
Behavior Support ~Behavior support methods used without consent of the individual or legal guardian are MUI's. ~The individual is physically aggressive at worksite and is locked in a room to calm down.
 
The use of any behavior support method, including restraint or time-out that is implemented in a manner prohibited by rules. ~The individual is taken to bedroom for fighting and staff holds the door shut so the individual cannot come out (no Behavior Plan in place).
Rights Violation ~Did the act negatively impact the individual's health and/or safety? ~Staff refuse to take the individual on a scheduled outing. Individual becomes upset and bangs head against wall.
~Staff padlocks the refrigerator. The individual sustains laceration trying to break the lock.
Series of Incidents ~Defined as 3 or more within a 7 day period or 5 or more within a 31-day period. ~The individual has fallen 3 times within 7 days and suffered minor scrapes and bruises.
Series of unusual incidents that may have an impact on the health and safety, as determined during the weekly review of unusual incidents. ~It must have a negative impact on the individual's health and safety. ~Medications were not given to an individual for 4 days in a row, resulting in increased agitation.
